User information, such as the name, username, password, email address, photograph or other likeness, settings, associations with bands and fans, purchase history, and any other information you provide in connection with your user account. User financial information, such as your credit or debit card number, bank account number, and billing and shipping address. This information is collected and processed by our payment processor, as necessary to complete your purchase. We do not receive your credit card information directly, but we may receive information about the transaction, such as the date and time it occurred. This information may or may not be associated with an existing user or fan account on the website. Band information, such as user-provided biography, location, and tags. Band financial information, such as Paypal account(s), Stripe account(s), Pro/label subscriptions, and payouts. Fan information, such as the user-provided name, email address, country of residence, zip/postal code, picture, location, and biography. Emails and messages, including receipts, newsletters, and support contact. This information consists of the emails we send to individuals, and the messages that users may send to one another. In addition to the above, we may automatically collect the following types of information: Website activity information, such as application logs, data files, information collected by cookies, IP address, browser information, and metrics generated in the normal operation of a website. “Application logs” are text files in which are recorded most of the activities on a website, including page visits, payments, and usage. Website activity information is sometimes associated with an IP address or other Personal Data. Third parties may also collect information about your website activity over time and on other websites or mobile applications. Information collected via cookies. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your browser to enable our systems to recognize your browser and tell us how and when pages in our site are visited and by how many people. Other than as explicitly outlined in the ‘Analytics and Third-Party Tracking Technologies’ section below (applicable only where you have actively consented to the use of advertising cookies), Bandcamp cookies do not collect Personal Data, and we do not combine the general information collected through cookies with other Personal Data to tell us who you are or what your screen name or email address is. Bandcamp may share Personal Data with group members, including affiliates, when disclosure is reasonably necessary or desirable for stated processing purposes.

Users grant Company a worldwide, perpetual, irrevocable, sublicensable, and transferable license to exploit User Submissions in connection with the Site, Service, and Company's business.

The Company may terminate access to all or any part of the Service at any time, with or without cause, with or without notice, and effective immediately.

Artists are individually responsible for compliance with all consumer rights laws applicable to their Merchandise Transactions, including EU and UK Consumer Rights Laws. International/Non-California Use. Other than its requirements to comply with the EU’s Digital Services Act, Company makes no representation that the Content is appropriate or available for use in locations outside of California, and accessing the Service is prohibited from territories where such Content is illegal. Save in respect of users based in the EU, if you access the Service from other locations, you do so at your own initiative and are responsible for compliance with local laws. Dispute Resolution. A printed version of these Terms of Use and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms of Use to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. You and Company agree that any cause of action arising out of or related to the Service must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred. These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, excluding its conflicts of law rules, and the United States of America.

Payments for purchased Artist Subscriptions automatically renew at the end of each subscription period unless canceled before that period ends. This finding is limited to Terms of Use | Bandcamp.

From: Terms of Use | BandcampHowever, you understand and agree that Bandcamp is a platform that Artists use to sell their products, and the Digital Content is derived from files provided by the relevant Artist, and the relevant Artist is solely responsible for such files. Your total price for each Transaction will include the price of the product plus any applicable tax. If a Transaction is subject to any type of sales tax, value added tax, goods and services tax, or similar indirect tax (collectively, “Sales Tax”), then you agree that we may charge you for those Sales Taxes and that you will pay all the fees and Sales Taxes you incur as applicable. If you purchase an Artist Subscription, your payment for such Artist Subscription will automatically renew at the end of the applicable subscription period, unless you cancel your Artist Subscription before the end of the current subscription period. The cancellation will take effect the day after the last day of the current subscription period. Content you purchase in a Transaction cannot be guaranteed to be available to you perpetually. For example, if we receive a notification of claimed infringement from a copyright owner or its agent with respect to specific Content, then we may be required by law to remove that Content from the Service and not make it available for future sale and we may also have to deny continued access to anyone who previously purchased such Content. This means that you may lose access to purchased Content previously available to you through the Service. If we are required by law to deny access through the Service to previously purchased Content, including by removing access to Content from a user’s personal collection through any mobile application, then Company will not provide the user who purchased that Content with a refund, except as required by applicable law.
